RENTAL AGREEMENT
1. Receipt and Condition
Lessee acknowledges receipt of the described personal property. Both parties agree that the property was inspected by the Lessor and personally examined by the Lessee at the time of delivery and was accepted as being in good and serviceable condition.
2. Ownership and Usage
Title to the rented property remains with the Lessor at all times. Only the parties in this agreement and any individuals listed herein are authorized to use the property. The Lessee will not allow the property to be used by others or at a location other than that designated without the Lessor’s consent.
3. Warranty and Repairs
The Lessor does not provide warranties against evident or hidden defects in the material, workmanship, or capacity, nor is the Lessor responsible as an agent of the manufacturer. If the rented property becomes unsafe or in disrepair, the Lessee agrees to discontinue use immediately and return it. If the condition is not the Lessee's fault, the Lessor will replace it with a similar item in good working order.
4. Return and Damage
Upon termination, the Lessee shall promptly return the property in the initial condition, excluding ordinary wear and tear. The Lessee agrees to pay for damage or loss while in possession. Collection charges, including attorney's fees, apply in case of litigation.
5. Liability and Indemnification
The Lessor is not liable for any loss or damage due to defects or failure of the rented property. The Lessee agrees to indemnify and save the Lessor harmless from all losses or damages arising from the operation, handling, or transportation of the property during the rental period.
6. Legal Procedures and Seizure
The Lessee will immediately notify the Lessor of any levy or seizure attempts and indemnify the Lessor against any losses resulting from such actions.
7. Rental Duration and Payments
The Lessee will not retain the rental property beyond the due date without notifying the Lessor. Fees are to be paid in advance unless otherwise agreed. If not returned after five days beyond the due date, the property may be reported stolen.
8. Damage Waiver Charge (DWC)
A DWC of 75% of the rental fee covers accidental damage or breakage, excluding negligence-related incidents. Damaged items must be returned. The Lessee pays full cost with shipping fees for missing items or damages from negligence or misuse.
